Please file something with steam. If they know it's a legal dispute they most likely won't sell the game. I also might review bomb it so I can tell people it's stolen.

I refunded the game stating that you didn't say you were okay with the release then added a link to the X profile. Not much but better than nothing if you ask me.

report it to steam as stolen property and tell them there's an ongoing legal investigation. By Law Steam are not permitted to sell the game if it's under investigation. I have reported it myself, but you must file a Copyright claim as the owner.
