There is no way they can win a RICO case. To prove a RICO claim against an individual person who represents themself as a single person. They have to prove Enterprise, activity, pattern, and injury. If you are missing 1 facet, obviously enterprise and pattern, the RICO claim will be dismissed in a Motion to Dismiss.
Treble damages are extremely hard to get, and are generally included in a complaint because you want to cover all bases. A judge might get upset that RICO was included in the complaint in this case.
Ludwig forgot to mention that Ben took B&M to small claims court, WON and then B&M shut that store down to avoid paying the LEGAL verdict. Insane.
