Every other country in the world has figured out how to protect its public employees from being sued without allowing the reckless violence and murder. The American police are allowed to perpetrate and get protected by qualified immunity. It's one of the worst policies in the modern world by any government. It's why your police kill more of your citizens than any government on earth.

Saw a break down of the google search warrant by a civil rights lawyer today - in it he pointed out that the warrant was extremely broad and that a recent legal case last year, basically means any such warrant that uses the word “all” is likely to be deemed illegal by being over broad and not specific - meaning any and all information obtained by it would become inadmissible too. Basically, that warrant should not have been granted by the judge and it can almost certainly not only be challenged, but the officer who signed it likely lost qualified immunity too. Which means they are individually liable and can be sued, yes.

Some context: a lot of officers believe that individuals lie about overdoses because they end up going to the hospital instead of jail. I think that might be what have happened with this officer, absolute scum of the earth either way

I want to clarify the google search warrant. Officer Dore wrote (and lied on) an affidavit for a search warrant/subpoena, took it to a judge. The judge signed it. Dore submitted it to Google. Google had no legal choice but to comply with the order. Google, in my opinion, isn't the primary bad guy here, that would be Officer Dore that lied on the affidavit to the judge. The issue I have with Google is more about corporations farming our data to sell to advertising agencies. Google has waaay too much of our personal data.

Ben, I love you man, but bone up on the law a little so can play on a more even field. The police don't "sue" you, but they can "charge" you with a crime. You consistently mix up criminal and civil actions you are facing. And what your options are to fight against those things. The system isn't necessarily corrupt, its just that you (as a lay person) don't know the rules of the game. You don't know at what stage which arguments are pertinent, and how to manage these matters. But the good news is, not fending of the TRO ahead of time will ultimately work to your advantage in counter claims, should you pursue them. Still, let the lawyers do their thing. But since you intend to talk about it publicly, make sure you got the lay of the land and really grok what is going down and why. In the end, you are likely to prevail against it all and come out ahead. Don't discount the harm done to you, and its ramification for journalism (youtuber or otherwise) everywhere. You are a warrior.

Qualified immunity works like this: for every day people, ignorance of the law is no excuse. For cops, unless it is “clearly established” in a prior case, cops cannot be expected to have known what the law is, so they are immune. This was made up by federal judges before either of us were born, but LONG after the Constitution was written. There is no law giving cops this, there is nothing in the Constitution giving cops this, judges just decided it. And no, it wasn’t made for cops. It was made for desk bound bureaucrats for the Nixon administration who fired a contractor who was a whistleblower. The whistleblower sued, and the courts invented Qualified Immunity. Since cops are government officials, they get covered too, and today are the main beneficiaries of a doctrine that wasn’t even made for them.

She didn't lie to Google, she lied to the judge to get the warrant. That was under criminal penalty so she should be facing charges for that, but Google just complied with the warrant because they don't have a lot of other options. Probably the judge who signed the warrant would argue that the warrant is reasonable given the information he received, which a cop swore was accurate. To avoid this kind of situation in the first place, never trust cloud storage or unencrypted email. Not in general but especially not as a journalist. The dirty cops in Provo are now armed with all this private information they can use against you and it's too late to do anything about it. But your lawyers should be aware, at least, so they can demand the information is erased (not that they won't have copies, probably) and make sure evidence derived from it gets dismissed if they try to use it in court.

Qualified Immunity is the *name* for the special "magic" shield that makes cops almost impossible to charge with a crime up to and including murder. If a cop is "on duty", then almost anything they do is protected no matter how fucked up as long as it can be spun as just a normal part of a cop's duties. If she lost her immunity shield in relation to her handling of that case, that means the judge doesn't believe she was acting in a manner appropriate for a cop. It means she's super vulnerable to being sued over that incident.

Hey Ben, I just wanted to share a few things with you that I’m sure you’ve already heard from any others. I initially found your story from the civil rights lawyer. I enjoy watching his channel because it’s all about exposing unlawful activities within police departments and what is just and what is criminal. There are many times that you seem to be trying to give bricks and many figs a way out either by providing information during an interview and saying you would drop your channels and what not as well as drop lawsuits if they do the chicken Dance, etc., but I really hope that’s not true. For people like me and the people that live in the American Fork police department area it is extremely important that you hold that department accountable. It’s not about suing them to get money from the county, etc., because they have insurance for things like that. It’s about forcing them to realize that the way they conduct their department is unlawful and criminal. Since your story came out with the false arrest, many other cases have become highlighted as well that shows the depth of the corruption. From the unlawful traffic stop accusing the driver of not using a blinker, when they clearly did even if it wasn’t within 100 feet that’s not what the Officer stated was the reason for pulling him over and was clearly a lie. That illegal traffic stopped alone did not give them probable cause to do anything further from that moment on. As well as the raid, etc. this is the most corrupt police department I have seen in all the years of my watching police encounter videos. I know your heart’s in the right place and your mission is to make Brayan and his family whole again, but I think you should add another mission to that which is helping the people in American folk clean house of this corrupt police department. I think exposing that department should be equally as important moving forward for you as the bricks and mini figs thing. It sucks to learn that the system and is about justice is so hard to navigate, much less win with the truth. It really should be as simple as showing them the evidence that you didn't do the things they claim that you did, but it's not. Next you are going to learn that even though these charges were issued because they said you said some things, whenever you prove that you didnt say them they will still charge you with it but they will shift gears and start bringing up things that they've never mentioned before amd tie those things in to prove that you are attempting to extort them. It will work too. It will be things that you said or did totally in context of something else but the simole fact that it happened is good enough for the courts to believe that it happened for the purposes of extortion. This is why the prosecution said that a video doesnt show everything that happened. They will go back months and pick at everything. The fact that you started a crowd funding campaign will be used to say that you caused the business harm and were rewarded monetarily for it. They will say that was extortion. They will say that your YouTube and patreon following has increased and that is a direct form of extortion. You might want to start a company and transfer ownership of your YouTube channel over to it for the purposes of income and taxation. Id ask an attorney about it. But dont ask or bring up or even consider doing that to protect the channel. If you did that, they could use that as evidence that you did somwthing wrong and now you are trying to hide assets after getting in trouble. It could be seen as a sign of guilt.because at this point the courts have the authority to make you delete your channel if they find that it needs to happen because it was illegally obtained. If you had an attorney on the first court date your attorney might have been able to fight this and prove no probable cause due to the accusation only being here say, but not now. You have a DA who has to prive that he is charging the criminals and a judge who has to provw that he punishes the criminals. Just because it never happened doesnt mean anything. You have a system stacked against you, by design. If they drop the charges and let you go, they are showing that they are not doing their jobs. So please whatever you do, do everything your attorney says. Take everything you have and know to your attorney so that he can fight all of this. And unless you knownfor a fact that something you do isnt going to be used against you, meaning that if there is any question at all if it could be used against you, run it by your lawyer before doing anything. You are in the system, in front of millions of people watching, so theres no doubt that you will go to trial over these charges. I believe 100% that if you listen to your attorney you will be just fine though. Good luck. We are rooting for you

That timeline is crazy, before you even visit Josh or Brandon they are lying to get your internet history… Make sure you keep local backups of all video on drives and that you keep a cold storage of it away from places authorities could get warrants for, a safe third party person that you do not share with anyone or communicate with digitally. Basically look into opsec practices, not for nefarious purposes but to protect yourself and your work from corrupt people in power.

Thanks for the update. One thing you might want to have your lawyers get, is a copy of BAM Corporates lease. To me it seems you are in a common area of a multi business building. Which unless BAM has express permission to trespass from common areas in their lease, they couldn't tell you to leave. Or even have authority to call the police for tresspass. This is just my understanding of trespass as someone who has been on both sides. If I am wrong about the common area thing or BAM actually owns the building then feel free to ignore.
