You might have figured this by now, but the reason they didn't strip Jinbei's Warlord title the moment they put him in Impel Down was because they were hoping he'd change his mind and choose to fight against the Whitebeard Pirates alongside the other Warlords. That's how desperate the WG were in their preparations for war against the Whitebeard Pirates. And it's not like they could find a replacement for Jinbei on such short notice.

He's a paramecia according to the wiki - he can produce and control poison but can't turn into poison (basically poison just covers his body and he can extend the poison out from his body)
