A recommendation after this, if you guys want to watch like an action-style rom-com, Strong Girl Bong-soon is a good option imo. Also, he doesn't have a red badge because it's for life sentences, I'm pretty sure.

This is what lil I know about the prison system in SK. red badge : sentenced to death penalty. Cho Gyu Cheol wasn't. There's also yellow, blue, white and pink with its own classification and security level.

I think the reason why the main villain kid doesn't have a red badge is cause if you remember, in like ep 4 or something like that, they showed the main guy's fiancée in the hospital, and THAT is when she passed away. So "technically speaking", the fiancée didn't die cause of the main villain kid "completely". (Obviously, the kid is the reason why she passed, but im guessing that since she didn't die right in front of the kid, that is why he doesn't have the red badge) idk if I explained it correctly, but that is what I think happened at least😭
Hmm I'm not sure if this is it? :) Legal COD doesn't care about time of death. He wasn't red tagged mainly cos he was a minor at the time of the crime. Under SK's Juvenile Act, minors under 18 cannot be given the death penalty/capital punishment.
